1. Who we are
Market One ("we", "us") is a marketplace for domains, websites and small online businesses, run by Iron Code Studios in Western Australia. These terms apply when you use marketoneweb.com, whether you browse, buy, sell or ask us for help.
By using the site you agree to them. If you do not agree, please do not use it. Contact: use the contact form and we reply by email.
2. What we do and do not do
We list assets, show the facts we hold about them, take payment through Stripe on Buy it now sales, and transfer assets by hand. We hold the domains and sites marked Managed by Market One. For a listing marked Listed by owner, the seller owns the asset and we introduce the parties.
We are not a bank, an escrow service, a lawyer, an accountant or a financial adviser. We give no legal, tax or financial advice. Ask your own advisers before you buy or sell.
3. Your account
You sign in with Omxus (auth.omxus.com). Keep your sign-in secure. You are responsible for what happens under your account. Tell us if you think someone else has used it.
You must be 18 or over and able to enter a contract.
4. Buyer obligations
- Read the listing before you buy. The facts and their sources are on the page. Check what matters to you with your own advisers.
- Pay the price shown for the asset you choose. Buy it now is a binding purchase once payment clears.
- Give accurate details so we can transfer the asset, such as an account at a registrar.
- Use the asset lawfully. You are responsible for it once it is transferred to you.
5. Seller obligations
- You must own the asset, or have the right to sell it, and be free to transfer it.
- Every fact you give us must be true and, where a number has a source, from that source. Do not overstate traffic, revenue, profit or age.
- Tell us about anything that affects the asset: a penalty, a dispute, a lien, a claim on the name, content you do not own.
- Be ready to transfer the asset once the buyer pays, and help us do it.
- We may refuse, edit or remove a listing, including one that is misleading, unlawful, or priced in a way that misleads buyers.
6. Offers and prices
The price on a listing is the Buy it now price. An offer is a request. It does not bind the seller or Market One until the seller accepts it and we confirm it in writing by email. A seller can decline or counter any offer.
We may correct an obvious price error. If we do, we tell you before you pay.
7. Payment
Buy it now payments are made by card through Stripe Checkout. Stripe handles your card details. We never see or store your full card number. Stripe's own terms apply to the payment. We pay Stripe's processing fees; see Fees.
Prices are in US dollars unless a listing says otherwise. Taxes are your responsibility unless we say we have included them.
Do not pay a Market One deal outside Stripe Checkout, or send money to a bank account quoted in an email, unless we have agreed that route in writing.
8. Transfer
After payment clears, we transfer the asset by hand. We aim to start within one business day. Domain registrars and other third parties can add time that we do not control, and we tell you if that happens.
We confirm to the buyer by email when the transfer is done. The buyer should check the asset promptly and tell us of any problem within seven days of that email.
9. Refunds if a transfer fails
If we cannot transfer the asset to you, or it is not as the listing described in a way that matters, you get a full refund of what you paid for it, through Stripe. We decide this by looking at the listing and what was transferred. We will explain our decision in writing.
A refund is not owed because you changed your mind after the asset was transferred, or because a lawful, disclosed feature of the asset (for example a renewal date) works as described.
Nothing here limits any right you have under Australian Consumer Law that cannot be limited.
10. Introduced deals: no going around us
If Market One introduces a buyer and a seller, or a buyer finds an asset through us, both must complete that deal through Market One. Do not use the introduction to agree a sale elsewhere to avoid a fee. This applies during the listing and for 30 days after it is removed.
If you do, we can suspend your account and the seller owes the commission that would have been due on the sale. Where we are told of a deal done this way, we may ask the buyer for the details.
This does not stop you buying or selling a different asset, or one you already had a deal on before we introduced it.
11. Valuations and information
The valuation tool and any figure we describe as an estimate are estimates only. They are not advice, a promise, or an offer. Real prices depend on the buyer and the day.
We try to keep listings accurate and name the source of each number, but we do not guarantee that third-party figures such as traffic or authority scores are correct. Check what matters to you.
Templates and checklists we publish are general information. They are not legal advice. See Legal templates.
12. Confidential and private sales
For Market One Private deals, we ask each party to sign a non-disclosure agreement before sharing detail. We treat what you tell us as confidential and use it only to run your sale or answer your request.
13. Acceptable use
Do not list what you do not own, post false information, harass others, scrape the site in a way that harms it, try to break its security, or use it for anything unlawful.
14. Our responsibility
We take care with the site and the transfers we do. We are not liable for losses that were not reasonably foreseeable, for loss of profit or of future traffic or revenue from an asset, or for the acts of third parties such as registrars, payment providers and search engines.
Where the law lets us limit our liability for a thing, it is limited to the price you paid for the asset concerned. Nothing in these terms excludes anything that cannot be excluded by law.
15. Your information
We keep the details you give us (such as name, email and what you ask for) to run your account, answer you and complete deals. We do not sell them. Payment details stay with Stripe. You can ask us what we hold and ask us to delete it, subject to records we must keep.
16. Changes
We may update these terms. The date at the top shows the latest version. A change does not alter a deal you have already made.
17. Governing law
These terms are governed by the laws of Western Australia, Australia. Disputes go to the courts of Western Australia. We would rather talk first: use the contact form and tell us what went wrong.
